Terms of Service

These terms are an agreement between you and Megamite Lab ("we", "us"), operated by Pittawat Sommai, about the game Monia Online and its website. By creating an account or playing, you agree to them and to our Privacy Policy. If you don't agree, please don't play.

1. Who can play

You must be at least 13 years old to play. If you are under 20 (the age of majority in Thailand), you need a parent's or guardian's permission to play and to make purchases, and they accept these terms for you and are responsible for your purchases.

2. Your account

• You can play as a guest, with a username and password, or by signing in with Apple or Google.
• A guest account is tied to the device that created it. If you delete the app or change device before linking the account to Apple or Google, you may lose it for good, and we may not be able to recover it.
• Keep your sign-in safe. You are responsible for what happens on your account. Tell us at once if you think someone else is using it.
• Your account is personal. Don't sell, buy, lend, share or transfer accounts or characters.
• Character names must follow the rules in section 5. Names that impersonate staff or break the rules may be refused or changed.

3. Diamonds, gold and items

• Diamonds (the premium currency), gold, items, pets, cosmetics, Premium time and everything else in the game are a limited, personal, non-transferable licence to use them in the game. You don't own them, and they have no cash value.
• They can't be exchanged for real money or anything outside the game, by us or by anyone. Buying or selling diamonds, gold, items or accounts for real money outside the game ("real-money trading") is forbidden.
• Inside the game, players may trade some items for gold, and diamonds for gold on the in-game Exchange, under the game's rules. Some items can't be traded at all: Mall items, soul-bound gear, account-bound rewards, locked items and starter pets.
• Diamonds don't expire while your account exists. Diamonds and items aren't refunded when an account is deleted or banned, except where the law requires it.
• We may change, rebalance or remove game items, prices, drop rates and features to keep the game working and fair. If a bug or exploit grants items, gold or diamonds by mistake, we may remove them.

4. Purchases, Premium and refunds

• All purchases are made through the Apple App Store or Google Play and are subject to their terms. They take the payment; we deliver what you bought to your account.
• Premium is an auto-renewing monthly subscription. It renews at the price shown until you cancel it, at least 24 hours before the period ends, in your Apple ID or Google Play subscription settings. Deleting the app or the account does not cancel it.
• Refunds are requested from Apple or Google under their policies; we can't refund store purchases ourselves. When a store refunds a purchase, we take back what it delivered. If those diamonds were already spent or traded, the account may be suspended until the balance is settled with support.
• Nothing in these terms limits your rights under Thai consumer protection law.

5. Rules of conduct

Play fair and be kind. You must not:

• Cheat: use hacks, bots or macros, modified or unofficial apps, or tools that automate play beyond the game's own Auto mode; exploit bugs (report them instead); or interfere with the servers or other players' connections.
• Harass, threaten, bully or stalk anyone, or post hate speech, sexual content, or violent or illegal content.
• Scam other players, or pretend to be staff, Megamite Lab or another player.
• Trade, buy or sell game items, currency or accounts for real money.
• Share other people's personal information, or spam and advertise.
• Use names that are offensive, misleading or break these rules.
• Try to get into accounts that aren't yours, or into our systems.

6. Chat, reports and penalties

• Chat is filtered automatically for some words, and chat lines are logged for 30 days so staff can review reports. You can block or report any player from the player menu.
• If you break these terms we may, depending on how serious it is: warn you, mute your chat, remove items, gold or diamonds gained unfairly, change a name, suspend the account for a period, or ban it permanently. Serious or repeated breaches can lead straight to a permanent ban.
• If you think a penalty was a mistake, email support with your account name.

7. Your content

You keep the rights you have in what you write in the game (chat, names, notes). You give us a free, worldwide licence to store, show and use it to run, moderate and improve the game. Don't post anything you don't have the right to share.

8. Changes to the game and the service

Monia Online is an online game that changes over time. We may update, add or remove content and features, run maintenance, or limit access in some places. The game needs an internet connection and may sometimes be unavailable. We may end the service; if we do, we will announce it in the game at least 30 days before.

9. Ending your account

You can delete your account at any time in Settings > Account > Delete account (it is deleted after 7 days; see the Privacy Policy). We may suspend or close accounts that break these terms, as described in section 6.

10. Our rights

The game, its art, music, code, names and logos belong to Megamite Lab or its licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the game for your own entertainment under these terms. Don't copy, modify, reverse engineer or sell any part of it, except as the law allows.

11. Warranty and liability

We work hard to keep the game running well, but it is provided "as is" and "as available", without promises that it will always be available or free of errors, as far as the law allows. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of virtual items. Nothing here limits liability that cannot be limited under Thai law, including for gross negligence or wilful misconduct.

12. Apple and Google

These terms are between you and Megamite Lab, not Apple or Google. Apple and Google have no duty to provide maintenance or support for the game and are not responsible for it or for any claims about it. If the app fails to meet a warranty that applies, you may tell Apple, and Apple may refund the app's purchase price (if any) as its terms allow. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not barred from receiving apps under applicable law.

13. Law and disputes

These terms are governed by the laws of Thailand. Before going to court, please contact us so we can try to fix the problem. Disputes go to the courts of Thailand.

14. Changes to these terms

We may update these terms. The date at the top shows the latest version. For important changes we will tell players in the game before they take effect; if you keep playing after that, the new terms apply.
